Agreeing to these terms
These terms cover your use of the A&K Clarksville Concrete and Masonry website and any estimate, project or service you get from us. When you use the site, ask for an estimate or hire our crew, you agree to these terms.
If you sign a written estimate, proposal or contract with us for a specific job, that document controls wherever it says something different from this page. If you don't agree with these terms, please don't use the site, and call us before you book any work so we can talk it through.
Who we are and what we do
A&K Clarksville Concrete and Masonry is a masonry contractor in Clarksville, TN. We're licensed and fully insured, and we do brick, block, stone and concrete work for homeowners in Clarksville and the cities around it. You can see the full list of services on our home page and read more about our crew on our about us page.
The cities with their own pages are a guide, not a boundary. If you're nearby and not sure we come out your way, ask us.
Information on this website
Everything on this site is general information about masonry and concrete work. It isn't a quote, an engineering opinion or a promise about your house, because we can't judge a cracked foundation, a leaning wall or a failing chimney until we've seen it in person.
We try to keep the site accurate and current, but we provide it as it is, and we don't promise it will always be available, error-free or complete. Links to other websites are there for your convenience, and we aren't responsible for what's on them.
Estimates and pricing
We give free on-site estimates, with no pressure and no obligation. An estimate is based on what we can see and measure on the day we visit, the materials you pick and how easy it is to get our equipment to the work.
Masonry hides things. Once a wall is opened or old concrete is broken out, we sometimes find rotted framing, a footing that isn't there, soft brick behind the face or soil that won't hold a base. When that happens, we stop, show you what we found and explain what it changes, and we don't do extra work or add charges until you've approved them in writing.
An estimate holds for the period written on it. After that, material prices can move, and we may need to update the number before we schedule the job.
Scheduling, weather and cancellation
We'll give you a start date and a rough timeline, and we'll keep you posted if it shifts. Dates are our best plan, not a guarantee, because rain, freezing temperatures, material deliveries and permit or inspection timing can all push a job back, and we won't lay mortar or pour concrete in conditions that would weaken it.
If you need to reschedule or cancel, let us know as early as you can by phone or through our contact page. If you cancel after we've ordered materials that were made, cut or special-ordered for your job, or after work has started, you're responsible for those materials and the work completed up to that point, as your written agreement describes.
What we need from you
We need clear, safe access to the work area, a place to stage materials and equipment, and access to water and power if the job calls for them. Please keep kids and pets away from the work area while our crew is there.
Tell us about anything underground we wouldn't know about, like sprinkler lines, private gas or electric lines to a shop, septic lines or drainage pipe, because the public locate service only marks the utility companies' lines. You're also responsible for confirming your property lines and getting any approval your homeowners' association requires. Your written agreement says who is handling any building permit the job needs.
Payment terms
Payment amounts and due dates are set out in your written estimate or contract. Some jobs need a deposit before we order materials, and larger jobs may be billed in stages as the work moves along.
The final balance is due when the work is complete, unless your agreement says otherwise. If a payment is late, we may pause work until it's caught up, and we keep the rights Tennessee law gives contractors who aren't paid for their work, including lien rights on the property.
Our workmanship and what isn't covered
We stand behind our work, and we guarantee your satisfaction on every job. If something we built or repaired isn't right, call us and we'll come look at it and make it right if the problem is ours.
Any written warranty for a specific job is spelled out in your contract, and warranties on bricks, block, pavers, stone and other products come from their makers and pass through to you. Apart from those, and as far as the law allows, we don't make any other warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose.
Some things come with the material and aren't defects. Concrete usually gets hairline cracks as it cures and settles, new mortar and brick rarely match old work exactly in color, and a white powder called efflorescence, salt the water pulls out of masonry, can show up on new work and usually fades. We're also not responsible for damage from settling or moving soil we didn't prepare, poor drainage, de-icing salts, freeze-thaw damage to work that isn't kept up, heavy vehicles on surfaces not built for them, or changes or repairs made by others.
Limits on our liability
As far as the law allows, A&K Clarksville Concrete and Masonry isn't liable for indirect, incidental, special or consequential damages, such as lost use of your property, lost income or the cost of other contractors, that come from our work or from using this website.
As far as the law allows, our total liability for any claim connected to a job is limited to the amount you paid us for that job. Nothing here limits liability that Tennessee law doesn't allow a business to limit.
If we disagree
Most problems get solved with a phone call, so call us at (931) 272-0045 first and give us a fair chance to look at it and fix it. If we can't work it out between us, we're both willing to try mediation before either of us goes to court.
These terms and any work we do are governed by the laws of the State of Tennessee, regardless of where you live. Any lawsuit about them will be filed in the state or federal courts that serve Montgomery County, Tennessee, and you and we agree to those courts.
Changes to these terms
We may update these terms from time to time, and the version posted on this page is the current one. The terms in place when you sign your written agreement are the ones that apply to that job.
Questions about these terms
If anything here isn't clear, call us at (931) 272-0045 or send us a message through our contact page, and we'll explain it in plain terms before you commit to anything.
